What does Article L8221-6 of the French Labour Code say about Freelancer classification?
Gepubliceerd op:
Article L8221-6 creates a rebuttable presumption that the persons it lists are not employed by a client (donneur d’ordre) when carrying out the activity for which they are registered or enrolled. It also states when an employment contract can nevertheless be established: the person must provide services, directly or through an intermediary, in conditions that place them under the client’s permanent legal subordination. The article is a starting point for classification, not a guarantee that every registered Freelancer is independent.
1. What rule does Article L8221-6 establish?
Paragraph I presumes that the persons expressly listed in the article are not bound to their client by an employment contract while performing the activity associated with their registration or enrolment. This is a presumption concerning the relationship with the client; it does not create a universal “Freelancer status”. Paragraph II expressly allows an employment contract to be established despite the presumption.
Toelichting
Registration gives the relationship a legal starting point: the person is presumed to be working independently for the client. If the way the work is actually organised shows that the client acts as an employer, that starting point can be overturned.
2. Who is covered by the presumption?
Paragraph I identifies three groups:
Certain registered natural persons, including those registered in the commercial and companies register, in the national business register for craft-sector activity, in the commercial agents register, or with URSSAF for the specified social-contribution purpose.
Certain registered passenger-transport operators carrying out the school or on-demand transport activities specified in the article.
Directors of legal persons registered in the commercial and companies register, and those legal persons’ employees.
The presumption concerns performance of the activity giving rise to the relevant registration or enrolment. These are the categories in the statutory text; the article should not be paraphrased as covering every person who calls themselves a Freelancer.
Toelichting
Check which registration the person or business relies on and whether the proposed services correspond to that registered activity. The provision also addresses people supplying services through a registered company, not only sole proprietors.
3. How can the presumption be overturned?
Paragraph II permits an employment contract to be established where a person covered by paragraph I supplies services directly or through an intermediary in conditions placing them under the client’s lien de subordination juridique permanente — permanent legal subordination. Code du travail
French case law explains legal subordination through the putative employer’s power to give orders and instructions, control their execution, and sanction failures. Work within an organised service may be an indication where that party unilaterally determines the conditions of performance. These elements explain how to examine subordination; they are not a checklist in which every item must appear in identical form.
Toelichting
Look beyond the contract title. Who tells the person how to do the work? Who checks compliance? What can the client do if its instructions are not followed?
4. What does the law say about consequences?
Article L8221-6 also provides that a client criminally convicted of concealed work under paragraph II must pay the employer social contributions calculated on the sums paid to the persons concerned for the period in which concealment of salaried employment was established. This is a specified consequence of a criminal conviction; it should not be presented as an automatic result of every disputed classification.
Toelichting
If a registered contractor is found to have worked as an employee, the client may face employment-related consequences. The particular employer-contribution rule stated at the end of Article L8221-6 applies in the criminal-conviction circumstances described there.
5. What does this Knowledge Item show?
Article L8221-6 requires two linked checks: whether the person falls within a listed registration category for the relevant activity, and whether the actual working conditions nonetheless establish permanent legal subordination to the client. Its presumption is meaningful, but it can be overturned. The detailed indicators of subordination belong in the next classification Knowledge Item.

If a purported Freelancer’s relationship is legally an employment relationship, the client may face employment obligations and claims arising from that status, as well as employer social-contribution exposure. A further finding of travail dissimulé — concealed work — requires the conditions of that offence, including intentional evasion of specified employer obligations. Reclassification alone does not automatically establish concealed work or a criminal offence.
What do French court decisions show about Freelancer misclassification?
French judgments show how the courts apply the legal-subordination test to specific working arrangements. Take Eat Easy and a 2020 Uber case identified platform powers that supported employment classification. A 2023 services case and two 2025 Uber cases show that control must be established on the evidence in each dispute. These decisions provide examples for assessing a relationship; they do not assign one status to everyone doing the same type of work.
What does it mean to be a Freelancer in France?
“Freelancer” is a practical description, not a single French legal status. A person providing services independently may operate in their own name as an entrepreneur individuel, sometimes under the simplified micro-entrepreneur regime. Services may also be supplied through a company, but the company’s legal form and the working status of the individual performing the services are distinct questions. A person working through portage salarial is an employee of the portage company. None of these arrangements, by itself, settles whether a particular client relationship is genuinely independent.
How do French platform-work rules affect Freelancer classification?
France has Labour Code provisions for certain self-employed people who work through electronic platforms, including social-responsibility rules where a platform determines the characteristics and price of a service. These provisions do not automatically make platform workers employees or guarantee that they are independent. The factual employment test still applies. The EU Platform Work Directive adds a framework for determining status and rules on algorithmic management, which France must transpose by 2 December 2026. Its future French implementing rules must be checked before this item is updated.
