When is a freelancer legally an employee under Polish law?
Gepubliceerd op:
Article 22 of the Polish Labour Code is the central rule for distinguishing genuine freelance work from employment. It describes an employment relationship as paid work of a specified kind, performed for an employer under its direction and at a place and time it designates. Work performed in those conditions is employment regardless of the contract’s name. A civil contract cannot lawfully replace an employment contract while the conditions of employment remain the same. The assessment therefore concerns how the relationship operates in practice.
1. What does Article 22 §1 define as employment?
Article 22 §1 states that, in an employment relationship, a worker undertakes to perform work of a specified kind for an employer, under the employer’s direction and at a place and time designated by the employer. In return, the employer undertakes to employ the worker for remuneration. These are the statutory characteristics against which a disputed freelance arrangement is assessed.
Toelichting
The key question is how much authority the client has over the person’s work. If the client directs the work and determines its organisation in the manner of an employer, calling the person a freelancer may not reflect their legal status
2. What happens when a freelance agreement does not reflect the work performed?
Article 22 §1¹ provides that work carried out under the conditions described in §1 is employment regardless of the name of the agreement. A B2B or civil-law contract must therefore be assessed against the way the person actually works.
Toelichting
The question is whether the agreement’s description of independent work matches the client’s actual role in directing and organising it.
3. Can the same work continue under a new B2B contract?
Article 22 §1² prohibits replacing an employment contract with a civil-law contract while retaining the employment conditions described in §1. The rule is relevant when a person moves from payroll to a freelance arrangement but continues working in substantially the same way
Toelichting
Moving someone to B2B requires more than changing the paperwork if the client continues to direct their work as an employer.

Bekijk alle kennisWhen can a freelancer work without registering a business in Poland?
Poland permits an eligible individual to carry out small-scale paid activity as działalność nierejestrowana without registering a sole proprietorship in CEIDG. In 2026, revenue due from that activity must not exceed PLN 10,813.50 in any calendar quarter. The exemption concerns business registration; income tax, VAT, insurance arising from a service contract, and the legal classification of the working relationship must each be assessed separately. Exceeding the limit turns the activity into a business on the day of the excess and requires a CEIDG application within seven days.
How does social insurance apply to freelance work in Poland?
“Freelancer” is not a separate category for Polish social insurance. A sole proprietor, a person working under a mandate or service contract, and a person delivering a defined result may have different registration and contribution obligations. A person with more than one source of work must also check how the insurance rules interact. Social-insurance treatment is a separate question from employment classification: an arrangement that is found to be employment may require its insurance position to be reassessed.
How is freelance platform work classified in Poland?
A freelancer does not become an employee simply because they obtain assignments through an app or website. In Poland, the current question remains whether the work is performed under employment conditions within Labour Code Article 22. Directive (EU) 2024/2831 requires a further procedural protection for people working through qualifying digital labour platforms: a rebuttable presumption of employment where facts indicating direction and control are found. Poland has published an implementing bill, UC160, but the official materials reviewed on 5 October 2026 still identify it as a draft. Its proposed Polish procedures must therefore be distinguished from rules already in force.
How is freelance misclassification challenged and enforced in Poland?
A freelancer who works under employment conditions can challenge their classification through the labour courts. Since 8 July 2026, Poland’s State Labour Inspectorate (Państwowa Inspekcja Pracy, or PIP) has also had stronger powers to examine civil contracts and B2B arrangements. Following an inspection, an inspector can direct the parties to address an unlawful arrangement. If that direction is not followed, the district labour inspector may issue a decision establishing an employment relationship or bring a case before the labour court. These procedures enforce the existing test in Labour Code Article 22; they do not create a new definition of employment. Okręgowy Inspektorat Pracy w Białymstoku
