When can a Freelancer be reclassified as an employee in France?

Gepubliceerd op:

A genuine Freelancer can provide services independently in France. Reclassification becomes possible when the actual conditions of work establish an employment relationship, regardless of the contract’s title or the Freelancer’s business registration. The central question is whether the person works under another party’s legal subordination: its power to give instructions, check performance and sanction failures. This item explains the employment test; the separate Article L8221-6 item explains the presumption of non-employment.

1. What distinguishes genuine independent work from employment?

French courts assess the relationship as it is performed. Work and payment alone do not distinguish a Freelancer from an employee; the decisive issue is whether the work is performed under legal subordination. A genuine Freelancer may agree to a client’s project requirements, deadlines and expected result while retaining independence in how the service is organised.

Toelichting

A client can specify what it wants delivered. The classification risk increases when it manages the Freelancer like a member of its workforce, rather than purchasing an independent service.

2. Which forms of control can create reclassification risk?

Relevant evidence may include who sets working methods and schedules, how performance is monitored, whether the Freelancer can refuse assignments, and what happens after a refusal or alleged failure. The significance of each fact depends on the arrangement. Ordinary checks of a contracted result should be distinguished from continuing managerial authority over the person performing the work.

Toelichting

A client’s quality standards are normal in a commercial contract. Instructions, monitoring and sanctions that govern the Freelancer’s day-to-day work may point towards employment.

3. Do a freelance contract and registration prevent reclassification?

No. Contract wording and registration are relevant to understanding the intended commercial arrangement, but they cannot override contrary working conditions. Article L8221-6 establishes a presumption of non-employment for persons within its scope; it is rebuttable where services are performed in conditions of permanent legal subordination. Légifrance

Toelichting

Calling someone a Freelancer is not enough. The client and Freelancer should make sure that the way they work together reflects genuine independence.

How do French platform-work rules affect Freelancer classification?

France has Labour Code provisions for certain self-employed people who work through electronic platforms, including social-responsibility rules where a platform determines the characteristics and price of a service. These provisions do not automatically make platform workers employees or guarantee that they are independent. The factual employment test still applies. The EU Platform Work Directive adds a framework for determining status and rules on algorithmic management, which France must transpose by 2 December 2026. Its future French implementing rules must be checked before this item is updated.

What are the consequences of Freelancer misclassification in France?

If a purported Freelancer’s relationship is legally an employment relationship, the client may face employment obligations and claims arising from that status, as well as employer social-contribution exposure. A further finding of travail dissimulé — concealed work — requires the conditions of that offence, including intentional evasion of specified employer obligations. Reclassification alone does not automatically establish concealed work or a criminal offence.

What do French court decisions show about Freelancer misclassification?

French judgments show how the courts apply the legal-subordination test to specific working arrangements. Take Eat Easy and a 2020 Uber case identified platform powers that supported employment classification. A 2023 services case and two 2025 Uber cases show that control must be established on the evidence in each dispute. These decisions provide examples for assessing a relationship; they do not assign one status to everyone doing the same type of work.

What does Article L8221-6 of the French Labour Code say about Freelancer classification?

Article L8221-6 creates a rebuttable presumption that the persons it lists are not employed by a client (donneur d’ordre) when carrying out the activity for which they are registered or enrolled. It also states when an employment contract can nevertheless be established: the person must provide services, directly or through an intermediary, in conditions that place them under the client’s permanent legal subordination. The article is a starting point for classification, not a guarantee that every registered Freelancer is independent.
