What should clients check before engaging freelancers in 2027?

Preparing for 2027 starts with understanding how your freelance arrangements work today. This guide helps clients identify what to check, which questions need a closer look and what to resolve before approving or renewing an assignment.

The budget is approved, the freelancer is available and last year’s agreement is ready to reuse. Before signing, ask one more question: does the proposed arrangement still make sense as freelance work?

Start by comparing the agreement with how the work will actually be done. Have the duties changed? Who will direct the work? If an intermediary is involved, what will it be responsible for? The checks below help you spot what needs a closer look before you sign.

Does the assignment still match the work?

Start with the person commissioning the services and the freelancer. What is being delivered? Who decides how the work is performed? What happens if the scope changes or the work needs correcting?

For existing assignments, compare today’s responsibilities with the original description. A specialist hired to complete a project may now be handling continuing operational duties.

Next step: update the factual description and assess the relationship against those facts. Changing the wording alone will not change how the work operates.

The Belastingdienst recommends regular reassessment because working arrangements can develop over time.

Is a former employee genuinely returning in a different role?

A former employee may provide independent services. But if the work, instructions and responsibilities remain substantially unchanged, replacing a payslip with an invoice raises an obvious question.

Compare the previous employment with the proposed assignment. What freedom does the professional now have? What obligations have changed? Who bears the financial risk if the services are not delivered as agreed?

Next step: record the substantive differences and examine whether they support freelance work. A new title or a break between engagements is not, by itself, an explanation.

Employment classification requires the circumstances to be considered together under the Deliveroo framework, with relevant entrepreneurship also considered following Uber.

What does the intermediary actually do?

If a broker is involved, establish its role before assuming it has taken over the client’s responsibilities.

Zooly uses broker for a mediator who brings clients and freelancers together. In mediation, the client and freelancer enter into their service agreement directly. Under tussenkomst (intermediary contracting), the intermediary contracts separately with each party.

Next step: identify the contracting parties, their obligations and who directs the work. Establish which party has any payroll obligations under the applicable arrangement.

The Belastingdienst’s guidance on intermediary contracting also addresses possible deemed employment for payroll-tax purposes. An intermediary’s involvement does not settle classification.

Has management work through a BV been assessed?

An invoice from a besloten vennootschap (BV, a Dutch private limited company) identifies the contracting business. It does not answer every question about the individual performing management services.

Check the contractual chain, the person’s duties and authority, and any shareholding or director position. Employment classification, payroll treatment and employee-insurance status may require distinct assessments.

Next step: obtain a specific review where the arrangement relies on company ownership or director status. Avoid applying an ordinary freelancer checklist without considering those additional rules.

Do the records support the conclusion?

Keep an agreement that describes the services accurately, relevant evidence of how the assignment operates and a short explanation of the classification decision.

An approved model agreement provides assurance only within its conditions and where the parties actually work accordingly.

For lower-paid assignments, also check the hourly-rate employment presumption, which takes effect on 31 December 2026. Use the applicable indexed threshold. This affects the burden of proof; a higher rate does not establish independence.

Next step: list missing information and assign someone to obtain it before approving the arrangement.

Actionable compliance takeaways

Use the preparation period to make decisions, rather than simply collect documents:

  • Identify assignments with changed duties or unclear responsibilities.

  • Resolve questions with the freelancer and relevant intermediary.

  • Record why freelance engagement is appropriate.

  • Where employment is indicated, arrange the appropriate engagement model and assess any necessary corrections.

The Belastingdienst can already impose payroll corrections and additional assessments. These checks are practical preparation for 2027, not a reason to postpone an issue that needs addressing now.

When does charging a freelancer for access to work breach Dutch law?

An intermediary deducted 3.5% from a freelancer’s pay for arranging an assignment. The Arnhem-Leeuwarden Court of Appeal held that the fee breached Dutch law. The case shows why intermediaries and marketplace operators need to look at what the fee buys and how the assignment works in practice.

What is an FMS operator?

An FMS operator combines mediation between clients and freelancers with the administration of assignments through a Freelance Management System. In this model, the client and freelancer contract directly for the work. The operator supports their engagement without becoming the contractor responsible for delivering the assignment. A client needs an independent engineer. A business introduces a suitable professional, helps collect the documents and supports the agreement and invoicing. The engineer delivers the services directly to the client. The business remains involved throughout the assignment, but it has not employed the engineer or undertaken to deliver the engineering work itself. How should that role be described? FMS operator provides a useful name. In this article, it means a business that uses a Freelance Management System to connect clients and freelancers and administer their direct engagements. It builds on the mediation role—bemiddeling in Dutch—which Zooly has also described as the broker role. The term describes a business model. It is not a new statutory status.

Can a professional cyclist be self-employed while taking orders from a team director?

“Close the gap before the climb.” Imagine hearing that in your earpiece with a teammate on your wheel. The team director has spotted a move up the road, and you have seconds to respond. The instruction tells you what the team needs in that moment. To understand the rider’s working relationship, it helps to look at what happens after the finish. The men’s WorldTour rules allow teams to engage self-employed riders where the applicable law permits it, and they set conditions for pay and insurance. So who sets the rider’s training schedule between races? Can the rider negotiate an extra commitment? Who bears the cost if an injury keeps them off the bike? Together, those details help show how much independence the rider has in practice and who carries the financial risk. UCI Road Regulations, Article 2.15.115 bis

Can a freelancer’s entire invoice payment be frozen?

A creditor can have a bailiff freeze money that a client owes to a freelancer. The protected minimum that applies to wages does not automatically cover ordinary freelance invoices. Court protection may be available for recurring payments, while money already in a bank account follows different rules. The work is finished. The invoice has been approved. The freelancer is counting on the payment to cover rent, groceries and next month’s business expenses. Then the client receives a notice from a bailiff. A creditor has placed the payment under seizure, so it cannot simply be paid to the freelancer. Does anything have to be left for living costs? For an ordinary freelance invoice, the answer is not automatically. Dutch law distinguishes between wages, business payments and money held in a bank account. That distinction can make a considerable difference when a payment is suddenly stopped.
